SWIFT

Dear Clients,

In accordance with a series of normative documents adopted by the USA, after the events on September 11, 2001, the Treasury Department in USA got access, in order to fight against terrorist attacks financing, to some personal information regarding clients (natural persons) of financial institutions, within the framework of international funds transfer, by making use of the „SWIFT” program (Society for Worldwide Interbank Financial Telecommunication).

The utilization of services provided through the SWIFT program involves a personal data transfer from the territory of a member state of the European Union (Romania) to the SWIFT operational centers in USA or in Belgium.

The USA does not provide the same proper protection level as the Member States of the European Union, but it has the needed guarantees (Safe Harbour).

The operational center in SUA (the core center – owner of a centralized data base) is governed by the American law, and the authorities in USA have the right to request access to the personal data stored in the operational SWIFT center, with specific and limited aim, only in order to prevent money laundering and to help the fight against the terrorist attacks financing.

Processing the personal data (name, surname, IBAN code, address, a.s.o.) needed to make international funds transfer is made in accordance with the specific provisions of law no. 677/2001 regarding the procession of personal information and their circulation, normative document that gives access to the data (art.13) as well as the right to modify them (art.14).

The collection and the storage of information is done for a period of 5 years.

In order to carry out the rights above mentioned, a written and signed letter of request bearing also the date can be submitted in this respect to BANK LEUMI ROMANIA SA in Bucharest, 45, Aviatorilor Bd., District 1. In the content of this request the applicant will specify that he/she wants his/her information to be sent to a certain address, that can be also an e-mail address, or through a correspondence service that could ensure that the delivery is done only personally, in compliance with the confidentiality principle.
