Statement of the real beneficiary / person holding control over the account

The real beneficiary is any individual (natural person) that holds the control or controls the client in the end and/or the individual (natural person) on behalf of whom or for the interest of whom a transaction or an operation is directly or indirectly performed.

The notion of «real beneficiary» will include, at least:

a) For the legal entities:

  1. The individual/s who hold/s the control or who control/s a legal entity in the end, by owning, directly or indirectly, the majority shares package or a sufficient number of shares or voting rights to ensure the control, including bearer shares, the owned or controlled legal entity not being a commercial company whose shares are listed/traded on a regulated market and which is not subject to the advertising requirements according to what set by the European Community law or to what established at international level. This criterion is considered accomplished if owning 25% of the shares plus one share;
  2. the individual/individuals who have control in another manner on the administration or management bodies of a legal entity.

b) For the legal entities, others than the ones mentioned at letter a), or other entities or legal structures that manage or distribute funds:

  1. The individual who is the beneficiary of at least 25% of the assets of a legal entity or of a legal entity or structure, in case the future beneficiaries have already been identified;
  2. The group of persons for the main interest of whom a legal entity or a legal structure is set up or operates, in case the individuals who benefit from the legal entity or structure have not yet been identified;
  3. The individual/s who have the control over at least 25% of the assets of a legal entity or of a legal structure.
